The most important steps to a DUI case

On Behalf of | Dec 6, 2022 | Criminal Defense

Being convicted of a DUI can significantly impact your life and future. If you are facing DUI charges, you must understand the process you will go through. That involves everything from getting pulled over to your sentencing.

You cannot begin to help yourself until you understand these steps. However, once you do, you can find help to review your case and see if the officials conducted any of these steps incorrectly. Here are the most critical stages of a DUI case.

Roadside testing

After the police officer pulls you over, they will have you perform field sobriety tests. Some of the most common include the following:

  • Stand on one leg
  • Walk to a point and turn
  • Following a finger

If you have not completed these tasks satisfactorily, the officer will ask you to take a breath test. The officer will arrest you if you have a blood alcohol content higher than .08.

Jury selection

Right before your trial, the court selects your jury. Misdemeanors do not require an extensive jury. However, circuit courts hold felony DUI cases and demand 12 jurors. The jury makeup is essential because these people decide whether or not you are guilty. Since you are facing a suspended license and severe charges, a sympathetic jury is a nice bonus.

Remember to keep these steps in the back of your mind. Knowing them will help you take the appropriate steps to avoid a guilty sentence. While there is no guarantee you can avoid a penalty, this information will at least help you feel less overwhelmed during the process.
